1. Acceptance of Terms
Welcome to Power My Business. By accessing or using our website (powermybusiness.org) and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.
2. Description of Services
Power My Business is a commercial electricity consulting and brokerage firm operating in the Texas deregulated electricity market (ERCOT). We provide the following services:
- Commercial electricity rate comparison and analysis
- Contract negotiation assistance with retail electric providers (REPs)
- Electricity bill auditing and optimization recommendations
- Contract renewal tracking and management
- Demand charge analysis and reduction strategies
- Energy procurement consulting
Important: Power My Business is NOT a utility company, retail electric provider (REP), or solar installer. We are a licensed commercial electricity broker (PUCT Broker Registration: BR240245) that facilitates connections between Texas businesses and electricity providers.
3. Eligibility
Our services are intended for commercial and industrial businesses operating in Texas. You must be at least 18 years old and authorized to enter into contracts on behalf of your business to use our services.
4. User Responsibilities
When using our services, you agree to:
- Provide accurate and complete information about your business and electricity usage
- Respond promptly to requests for additional information or documentation
- Review all quotes, contracts, and recommendations carefully before making decisions
- Notify us immediately of any changes to your contact information or business circumstances
- Comply with all applicable laws and regulations
- Not use our services for any unlawful or fraudulent purpose
5. No Guarantees or Warranties
While we strive to provide accurate information and competitive rates, we make no guarantees or warranties regarding:
- The availability of specific electricity rates or providers
- The amount of savings you may achieve
- The approval of your application by any retail electric provider
- Future electricity market conditions or pricing
- The performance or reliability of any electricity provider
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied.
6. Broker Compensation
Power My Business is compensated by retail electric providers (REPs) when you enroll in an electricity contract through our service. This compensation does not increase your electricity rate or cost. Our goal is to find you the most competitive rate available, regardless of which provider offers it.
We maintain relationships with multiple electricity providers in Texas to ensure you have access to a wide range of options. We do not favor one provider over another based on compensation.
7. Your Contract with Electricity Providers
When you enroll in an electricity contract through our service, you are entering into a direct contract with the retail electric provider (REP), not with Power My Business. We facilitate the connection and provide consulting services, but we are not a party to your electricity service contract.
You are responsible for:
- Reading and understanding all terms and conditions of your electricity contract
- Complying with the terms of your contract with the REP
- Paying your electricity bills directly to the REP
- Resolving any disputes or issues directly with the REP
8. Limitation of Liability
To the fullest extent permitted by law, Power My Business and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits or revenue
- Loss of data or business opportunities
- Electricity service interruptions or outages
- Billing errors by electricity providers
- Contract disputes with electricity providers
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount of compensation we received from the electricity provider in connection with your enrollment.
9. Indemnification
You agree to indemnify, defend, and hold harmless Power My Business and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our services
- Your violation of these Terms
- Your violation of any rights of another party
- Any inaccurate or misleading information you provide
10. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Power My Business or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
11. Privacy
Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
12. Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. Upon termination, your right to use our services will immediately cease.
You may discontinue using our services at any time. However, if you have already enrolled in an electricity contract through our service, you remain bound by the terms of that contract with the electricity provider.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Hidalgo County, Texas. You waive any right to a jury trial.
14. PUCT Compliance
Power My Business is a licensed commercial electricity broker registered with the Public Utility Commission of Texas (PUCT). Our broker registration number is BR240245.

15. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Power My Business regarding our services and supersede all prior agreements and understandings.
